Employees can make one or more family members as nominees. Nominating a family member for gratuity benefit helps the family financially in case of the employee’s death.

Who can be made a nominee?

Under the Payment of Gratuity Act, 1972, only family members can be made nominees. These include-

  • Wife
  • Children (both married and unmarried)
  • Parents
  • Spouse’s parents
  • Widow and children of deceased son

Under this process, you also get the option to nominate multiple family members and allot a specified share of gratuity to each of them.

What if there is no nominee?

In the absence of a nominee, gratuity is usually paid to the legal heirs of the employee. However, this can lead to delays and potential legal disputes, as the heirs may need to produce legal documents to prove their entitlement. Therefore, it is recommended to appoint a nominee to avoid legal hassles.

How to submit your gratuity nomination

For this, first you have to fill Form F. Form F is specified under the Payment of Gratuity Act, 1972 and is usually available through your HR department. Some basic information will be sought in the form, which is as follows-

  • Name and address of the employee
  • Name and address of the nominee
  • What is the relation with the nominee
  • Share of gratuity: Specify in the form how much gratuity each nominee will receive.
  • Signature: You will need your signature as well as the signature of a witness.

After filling the form completely, you have to submit Form F to the HR department or designated authority in your organization. Meanwhile, some companies may also provide digital submission options or online portals.
